Who Is Collecting Your Personal Data?

The Juniper Landscaping of Florida, LLC (“Juniper Landscaping,” “us,” “we,” or “our”) offers and maintains the website(s) located at www.junipercares.com and www.juniperlandscaping.com, including all subdomains and subparts, as well as our Sync and social media accounts on Facebook, LinkedIn, Twitter, and other platforms (collectively, the “Site”). When you visit the Site, call or visit our offices, meet with our representatives, purchase or request our services, or otherwise interact or communicate with us, you may choose to provide us with personal data that identifies you. Information is one of the most powerful and valuable assets in business today. The Juniper Landscaping Expert Company is accountable for the personal data in its custody, including any personal data that we transfer to third parties for processing, storage, or other purposes. This Privacy Policy explains how we collect, process, disclose and use your personal data, and it applies regardless of how you access the Site or provide your personal data to us. What Personal Data Do We Collect?

The amount and type of information that Juniper Landscaping gathers depends on the nature of our interaction with you. In each case, Juniper Landscaping collects information only insofar as is necessary or appropriate to fulfill the purpose of your interaction with us. For example, if you sign up for a Juniper Landscaping account, we ask you to provide a username and email address. If you engage in a transaction with us, we ask you to provide personal and financial information required to process your transaction.  If you engage in a transaction with us through your employer, we also collect information about your affiliation and contact information with your employer.

We collect the following information that identifies you (“Personal Data”):

  • Payment information (including credit card numbers and other payment related financial account information):
    • Your interactions, tendencies, and communications with Juniper Landscaping (including content of your conversations, correspondence, and email messages to us, history of online inquiries and contacts with Juniper Landscaping, interactions with sales representatives and customer contact records and notes)
    • Audio, electronic, visual, or similar information, including recordings of your voice messages to our employees and video of your visits to our offices
    • Customer Records and Purchase History (including paper and electronic invoices and purchase orders, details of your purchased or requested products/services and other customer records that contain Personal Data such as names, signatures, addresses, or employment information
    • Employment Information (such as information about your employer, company, job titles, employment history, contact information) 

From third parties such as public sources, lead generation services, social media, event organizers, trade organizations, and other commercially available sources

  • Statistics on your activities on the Site (such as the date and time of visits, the pages viewed, time spent at the Site)

  • Data collected through Cookies or other similar technologies, as discussed in more detail below 

Much of this Log Data does not identify you personally. However, we may associate this Log Data with your Personal Data. When we do, we will treat any such combined data as Personal Data until such time as it can no longer be associated with you or used to identify you.

We may combine information that we receive from the different sources described above; for example, we may create a profile based on Personal Information provided directly from you and input information regarding your interaction history with sales representatives into that profile.

Juniper Landscaping does not collect all of the above types of information in all cases. Juniper Landscaping may also collect information in an anonymized or aggregate format (in a way that does not identify you) and which is not subject to this Policy. Juniper Landscaping will not seek to collect certain types of sensitive or protected Personal Data from you, which includes but is not limited to your racial or ethnic origin, physical or mental health, religious beliefs, or biometric information.

What Is the Lawful Basis for Processing Your Personal Data?

We collect your Personal Data after receiving your explicit consent to do so. You provide this consent by checking the box prompt before submitting your data to us.

Our lawful basis for processing the Personal Information described in this Notice depends on the type of Personal Information and the specific context in which we collect it.

We will normally process your Personal Information from you only (1) where you have provided your consent for us to do so, (2) where we need the Personal Information to perform a contract with you or provide services or goods to you that you have requested, or (3) where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. In some cases, we may also have a legal obligation to process your Personal Information.

You are able to revoke your consent given to us for the use of your Personal Information at any time. Please note that even if you revoke your consent, we may continue to use your Personal Information if we have a separate lawful basis for doing so.

How Do We Use Your Personal Data?

We use your Personal Data in several ways including:

In addition, we may share your Personal Data with third-party services and advertising networks, such as Google Display Network or Google Analytics, that collect, monitor, and analyze Log Data to deliver online behavioral advertising that serves ads to you on Juniper Landscaping’s behalf on other sites throughout the Internet. Juniper Landscaping has enabled the following Google Analytics features: Google Signals, Granular Location & Device Data Collection, and Advanced Settings for Ads Personalization. When you visit the Site, you will have an opportunity to manage these Google Analytics features in a banner at the bottom of your screen.  You may choose to accept all of the features, opt-out of all of the features, or manage your preferences to some level of usage of the features in between all or none. Note that if you disable, delete, or refuse to accept usage of the Google Analytics features, you may not be able to use some features of the Site and/or some of our pages might not display properly.

How Do We Disclose Your Personal Data?

While we seek to limit disclosure of your Personal Data, there are certain circumstances in which we may disclose or transfer your Personal Data to certain third parties to perform services on behalf of Juniper Landscaping. By checking the box prompt before submitting your Personal Data to us, you expressly consent to our disclosing your Personal Data, as set forth below.

Disclosing Personal Data To Affiliates, Successors, and Agents

Disclosing Data Through Social Media 
Juniper Landscaping maintains social networking accounts and integrated tools on the Site that help us interact with you through social networking websites, such as Facebook, LinkedIn, YouTube, Instagram, and Twitter. We may also work with application developers who specialize in social commerce so you can connect to us, share your interests, express opinions about products and services, purchase our products and services, and generate interest in our products and services among members of your social networks. Using these integrated tools enables you to disclose your Personal Data to other individuals or the public, depending on the settings that you have established with social networking websites. If you use social networking website features integrated in the Site, we may collect or disclose the information you transfer to us, including your Personal Data.

If you do not want us to be able to access information about you, including Personal Data, from social networking websites, you must limit data collection and disclosure in the privacy settings on the Third Party Sites. We reserve the right to remove the Personal Data or other data of any person for any reason we, in our sole discretion, deem appropriate.

We may disclose your Personal Data if required to do so by law or in our good faith belief that such action is necessary to:

  • comply with a legal obligation;
  • protect or defend our rights, interests, or property, or that of third parties;

What Are Your Rights About the Processing of Your Personal Data?

You have the right to consent or withdraw your consent to the processing of your Personal Data at any time, subject to exceptions defined by law. To opt-out of receiving emails, direct mail, catalogues, or other communications, please email us at privacy@davey.com with the phrase “Privacy Opt-out” in the subject line and specify what you would like us to do (for example, Change my mailing preferences). To stop email communications from us, you can also follow the unsubscribe instructions set forth at the bottom of our promotional e-mail messages. You may also access and correct some of your Personal Data by logging into your online account, if you have one.

If you choose to limit our use of your Personal Data, you may not have access to certain functionality of the Site. If you change your privacy preferences in the future, that will not limit the lawfulness of any processing performed based on your prior consent. You may have additional rights, under the laws of your jurisdiction, with which we comply.  

Privacy Rights for California and Canadian Residents
If you are a California or Canadian resident, you have the following additional rights.

  • Access: You have the right to access a copy of your Personal Data that we hold about you, upon receipt of a verified request.
  • Deletion: You have the right to delete your Personal Data, upon receipt of a verified request, with some exceptions.
  • Correction: You have the right to direct, subject to the use of commercially reasonable efforts, the correction of inaccurate personal information that we have collected about you.
  • Equal Treatment: You have the right to equal treatment regardless of your exercise of your privacy rights. 
  • Opt-Out: You have the right to opt-out of the sale of your Personal Data at any time and the sharing of Personal Data for purposes of targeted or cross-context behavioral advertising. 
  • Limit Use of Sensitive Personal Data: You have the right to opt out of the use of sensitive Personal Data for the purposes of inferring characteristics about you. Juniper Landscapingdoes not collect sensitive Personal Data about you for the purpose of inferring any characteristics about you.

How To Exercise Your Rights About the Processing Of Your Personal Data
To exercise any of your rights, you or your authorized agent may call us at 1-800-445-8733 or email us at privacy@davey.com.  Before we may fulfill a request to access, correct, or delete your information, we are required to verify your identity.  We will ask you to verify, at a minimum, your name, address, email address, or telephone number.   When providing us this information, you represent and affirm that all information provided is true and accurate. If we are unable to verify that the consumer submitting the request is the same individual about whom we have collected Personal Data, or an authorized agent, we may contact you for more information, or we may not be able to meet your request.  Only you, or an agent legally authorized to act on your behalf, may make a verifiable request related to your Personal Data. If you are making a request as the authorized agent of a consumer, we will ask you also submit reliable proof that you have been authorized in writing by the consumer to act on such consumer’s behalf.

We will make every effort to respond to your request within 45 days from when you contacted us. If you have a complex request, we may require up to 90 days to respond. We may contact you within 45 days from the date you contacted us to inform you if we need more time to respond.

We offer links to opt out of the sale or sharing of Personal Data or to limit the use or disclosure of Sensitive Personal Data, which are available at links.   

Personal Data does not include: publicly available information; de-identified, aggregated consumer information; or information excluded from the scope of California privacy law, such as health or medical information covered by the Health Information Portability and Accountability Act (HIPAA) or personal information covered by certain sector-specific privacy laws, such as the Fair Credit Reporting Act (FCRA).

How We Secure Your Personal Data?

Juniper Landscaping has security measures in place to help protect your Personal Data. We secure your Personal Data by: keeping Personal Data up to date; storing and destroying it securely; using industry standards to protect Personal Data from loss, misuse, unauthorized access and disclosure, alteration, and destruction; and ensuring that appropriate technical measures, such as encryption, are in place to protect Personal Data. For example, when we collect credit card data, that information is encrypted and transmitted to us in a secure way. How Long Will We Keep Your Personal Data?

We will retain your personal data as long as necessary to carry out the function for which you provided it to us, including maintenance of your account. JUNIPER LANDSCAPING IS NOT RESPONSIBLE FOR THE POLICIES AND PRACTICES EMPLOYED BY, OR THE CONTENT OF, THIRD-PARTY SITES. We provide such links only as a convenience and the inclusion of a link on the Site does not imply endorsement of the linked site by Juniper Landscaping. If you provide Personal Data through any such Third Party Site, your Personal Data may be collected by the third party and controlled by the privacy policy of that third party. We suggest contacting those sites directly for information about their privacy policies and practices.
  • Deidentified Data: Any non-personally identifiable data we collect, including, without limitation, Log Data, domain names of your Internet Service Provider, your approximate geographic location, a record of your usage of the Site, the time of your usage, and aggregated personally identifiable information, but only to the extent the foregoing cannot be used to specifically identify you.
  • Aggregated Personal Data: Any aggregated Personal Data that can no longer be used to identify you will be treated as non-personally identifiable data under this Privacy Policy. 
  • Employees/Contractors/Applicants: This Privacy Policy does not apply to Personal Data of employees, contractors, job applicants, or their dependents, of Juniper Landscaping.

We Do Not Collect the Personal Data of Children

We do not intentionally or knowingly collect any Personal Data from children under the age of sixteen (16), nor do we target our emails to them. Children under the age of sixteen (16) should not submit any Personal Data through the Site. We encourage parents and legal guardians to monitor their children’s use of the Internet and instruct them to never provide Personal Data through the Site. International Privacy Laws

If you are visiting the Site from outside the United States, please be aware that you are sending information (including Personal Data) to the United States where our servers are located. That information may then be transferred within the United States or back out of the United States depending on the type of information and how it is stored by us. We will hold and process your Personal Data in accordance with privacy laws in the United States and this Privacy Policy. Please note that privacy laws in the United States may not be the same as, and in some cases may be less protective than, the privacy laws in your country, and while in the United States Personal Data may be subject to lawful access requests by government agencies. 

What If We Change This Privacy Policy?

To reflect changes in our business, legal or regulatory obligations and practices we may occasionally make changes to this Privacy Policy and will review this Privacy Policy for any such necessary changes at least every twelve (12) months. If we wish to use your Personal Data for a new purpose not covered by this Privacy Policy, we will make available to you a new Privacy Policy explaining this new use prior to commencing the processing of your Personal Data pursuant to the new Privacy Policy and setting out the relevant purposes and processing conditions. How You Can Resolve a Privacy Dispute with You?

If you have a complaint about this Privacy Policy or our privacy practices, we will work with you in an attempt to resolve your complaint. Please contact us at privacy@davey.com.  Please also refer to the arbitration procedures described in the Dispute Resolution section of the Site’s Terms of Use. BY CHECKING THE BOX PROMPT BEFORE SUBMITTING YOUR PERSONAL DATA TO US, WE EACH AGREE TO SETTLE DISPUTES ONLY BY NON-CLASS, INDIVIDUAL ARBITRATION, INSTEAD OF SUING IN COURT (EXCEPT CERTAIN SMALL CLAIMS). THE RULES IN ARBITRATION ARE DIFFERENT. THERE IS NO JUDGE OR JURY, LIMITED DISCOVERY RIGHTS, AND REVIEW IS LIMITED, BUT AN ARBITRATOR CAN AWARD THE SAME DAMAGES AND RELIEF, AND MUST HONOR THE SAME LIMITATIONS STATED IN THE AGREEMENT, AS A COURT WOULD. Josh Burton is a native of Lakeland, Florida, who has been involved in the green industry since a very young age. He studied Horticultural Science and Business Administration at Florida Southern College where he obtained a Bachelor of Science degree. The green industry is Josh’s passion and led him to run his own landscape firm for 23 years. 

 

Josh is a State Certified Irrigation Contractor, Certified Pest Control Operator and holds a  license with the Department of Business and Professional Regulation. His strategy is to develop a plan, set goals, and hold accountability. Dissecting contracts and breaking down a property into segments allows for a calculated approach that will ultimately provide the high customer satisfaction that is expected.

 

Josh believes that building great teams and placing people in the right positions are the keys to success. He focuses on the development of the people around him to achieve his goals.

Jim Jordan

Regional Director – West Central Maintenance Region

Jim has over 25 years of experience in operational management and customer service in the landscaping industry. He started as an Owner/Operator in landscape, construction, and janitorial services, gaining valuable experience in business ownership and management. He has excelled in the landscape industry as a Senior Manager for over two decades, specializing in landscape design and implementing strategies for productivity and customer service excellence.

 

His areas of expertise include operational excellence, driving growth, and implementing productivity improvements. Jim is recognized for his ability to lead teams to achieve high-performance standards while focusing on employee development and customer satisfaction. Jim has made significant contributions to the landscaping industry through his knowledge, leadership skills, and commitment to excellence. 

 

He has lived in Bradenton, Florida his entire life and is a proud father to three grown children: Morgan, Nick, and Tayler, who have given him five grandchildren. Outside of work, he enjoys spending time with family, especially his two granddaughters, and is an avid enthusiast of Harley-Davidson motorcycles. Jim enjoys the thrill of riding and exploring new destinations.

Kyle Leverette

Regional Director – Southwest Maintenance Region

Kyle Leverette hails from the mountains of North Carolina. He grew up working on golf courses and doing seasonal jobs with Christmas trees in the fall and cutting timber in wintertime. After graduating with a degree in turfgrass management, Kyle spent 15 years at various golf courses working his way up from an assistant to the head superintendent. He had a brief stint of commercial sod work in Florida before moving back home to North Carolina for golf course construction.

 

When the economy collapsed in 2008, Kyle furthered his career by changing to landscape maintenance, eventually relocating back to Florida. There, he was involved with the infrastructure of a large local landscape company, working with commercial installation and purchasing. Kyle keeps himself humble despite having many accolades during the past 3 years at Juniper and considers everything as simply part of
doing his job.

 

Kyle currently resides in Cape Coral, which provides him the perfect opportunity to enjoy his favorite pastimes of boating, fishing, and golf.

Joe Ferro

Vice President of Financial Planning & Analysis

Joe Ferro is a highly experienced professional with 20 years of experience in the landscape industry, 5 years of which have been spent at Juniper.  

 

With a degree in Accounting from Barry University, and MBA in Finance from Texas A&M, and a certified Pest Control Operator in Florida,  Joe brings a wide range of skill sets to Juniper. 

 

Joe was recently promoted to Vice President of FP&A, which aligns with this expertise in FP&A, finance, forecasting, budgeting, and mergers and acquisitions. He has successfully led significant projects, including building Juniper’s first full company budget and forecasting tools in 2020 and integrating 8 acquisition totalling $40M+ in 2022-2023. Joe is currently focused on financial planning and mergers and acquisitions growth strategies to support Juniper’s rapid expansion. 

 

Joe is currently located in Fort Myers, but was originally from Miami. He has been happily married for 13 years and enjoys traveling, biking, and the occasional game of golf.

Mark joined the company in 2021 as an Estimator and was quickly promoted to Estimating Manager in January 2022. His continued success led to his advancement to Director of Business Services later that year.

 

In his new role, Mark will continue to lead the Customer Care and Maintenance estimating teams for Juniper and take on new leadership functions in the development of the next generation of Juniper Sync as well as a centralized maintenance contract management process. Mark will report directly to Dan deMont, Chief Revenue Officer (CRO).

Jason joins Juniper with over 20 years of finance and accounting experience across various industries for Fortune 500 public and private equity backed companies.  He is credited as a dedicated, hands-on, and cross functional partner that drives financial performance through operational excellence. Most recently, Jason served as the CFO for Flexi International Software, Inc. where he led all core FP&A processes, accounting, financial audits, legal, tax and treasury management functions.  He developed financial and
cash flow forecast models, annual budgets, strategic plan and financial reporting processes and all associated models, KPIs and analytics.  


Jason earned his Bachelor of Science in International Business from Florida Atlantic University and completed the executive leadership and management program at the Wharton School.  He is a Certified Six Sigma Green Belt.  He resides in Naples with his wife and 4 kids and enjoys serving in the community and living a competitive bodybuilding lifestyle.

Jarrett Myers a Florida Native has been in the landscape industry for over 25 years. Of those 25 years 14 were as an entrepreneur. He is a Certified Pest Control Operator, Best Management Practice Certified and holds an AS degree in Computer Aided Drafting.


Challenging teams to never become complacent, along with educating clients on the ever-changing landscape industry challenges through soil science, irrigation technological advances, improvement in chemical sciences as well as all Junipers unique approach to property management drives Jarrett.


Jarrett’s passion is to prepare all team members to have a chance at a successful career in the landscape industry. “There is nothing more satisfying then watching someone you have groomed overtime to become today’s leader in the industry.”


In his free time, Jarrett enjoys the outdoor life, fishing, boating, kayaking and spending time with his beautiful wife Lori and daughter Hayley.

Vice President of Maintenance Operations – Florida

Nick Salerno is Juniper’s Vice President of Maintenance Operations – Florida. He brings over 18 years of landscape, maintenance, and contracting experience to the role and is dedicated to overseeing the development of his team. 

He is an FNGLA Certified Horticulture Professional (FCHP), BMP Certified, and holds a “turf management certification”.

Nick studied at The Ohio State University and earned a degree in turf grass management. After graduation, he moved to southwest Florida to pursue a career in the landscaping industry. Nick worked with a local landscape company and was quickly promoted to President of Field Operations after self-teaching himself the Florida landscape. Less than two years later, Nick became General Manager of a local nursery, sharing his passion for the Florida landscape with both retail and commercial clients. 

After three years of nursery management, Nick pursued his passion for turf management and started working in the golf course field as an assistant superintendent, quickly climbing his way to the role of superintendent. Nick has worked his way through many facets of the landscape and golf course industry and brings this expertise to his role at Juniper.

Nick is highly motivated and passionate about Juniper’s core values. He drives results by leading his team by example and is inspired by their care for their work.

Stacie Trace is our Chief Human Resources Officer with over 25 years of business experience ranging from accounting, training, safety, and HR. In the past 15, she has honed her skills as an HR Leader by focusing on optimization at all levels of an organization. 


Originally from Columbus, Ohio, Stacie earned her Bachelor of Science degree from The Ohio State University. She combined the knowledge she gained here with her passion for working with people to begin a career centered around a company’s most valuable asset: their employees.


During her time at Juniper, Stacie has proven to be a resourceful, collaborative, and engaging HR leader and has delivered impressive acquisition, training, and retention solutions. She is committed to ensuring that Juniper fosters an encouraging environment and is comprised of talented individuals from diverse backgrounds.


She has been acknowledged for her expertise in HR-related duties at the strategic level by the Society for Human Resources Management through the title of Senior Certified Professional. Stacie was also a recipient of the Diversity and Inclusion Champion Award of Licking County to acknowledge her efforts in both implementing and supporting diversity initiatives. 


While she enjoys working with all people, she is especially inspired daily by her four kids and husband. Outside of work, she spends her time going to the beach, boating, and doing home improvement projects.

Lew Marotti is Juniper’s Director of Construction. In his position, he has created scalable construction strategies for all stages of a project. By emphasizing client satisfaction, Lew ensures all construction-related projects have the resources necessary to succeed. 


Lew is a native Floridian and graduate of Florida Southern College with 20 years of experience in landscape construction and 30 years in the horticultural industry.


Lew has been married for 32 years and enjoys spending time with his wife and three children. Outside of work, he enjoys outdoor activities including gardening and baseball.

Robert Oulahan is Juniper’s Chief Financial Officer. He has spent the majority of his 25+ year career serving middle market companies in financial leadership positions. His experience includes years with “Big 4” accounting firms, Nasdaq-listed companies, and strong growth-focused entities. He has helped guide these businesses by implementing various financial and tax solutions that aligned with the company’s strategies and core values.


Robert graduated Rutgers University with Magna Cum Laude. After college, he successfully obtained his CPA certification and entered the financial space immediately after. 


He has specialized in the service industry and construction companies during his career in the public and private sectors. 


In his free time, Robert enjoys playing golf, traveling, and spending time on the beach.

Jake Rubin is Juniper’s Chief Operating Officer. He works to establish peak operational performance through the creation and implementation of best practices at all levels of the company.


By engaging with branch teams across the organization, Jake has delivered improvements to operating margins and established processes focused on increased efficiency and quality. He also partners with Juniper’s HR team to develop and deliver operational improvement training programs to all branch operations teams.


Jake has a background of over 15 years in leadership roles managing large-scale, private equity-backed, multi-state operations in the transportation, construction, landscape, and commercial services industries. He is very experienced in areas such as margin improvement, merger and acquisition integration, and asset management at an enterprise level. 


Jake is enthusiastic about Juniper’s mission and ensures that all processes are designed to best serve Juniper’s team and their clients.

Dan DeMont joined the Juniper team in 2011. At the time Juniper had one branch but was preparing for growth. As the company’s first business developer he focused on diversification in three categories. First, service offering. Second, client base. Third, footprint.

Dan and Brandon were the architects of Juniper’s Design, Build and Maintain strategy. This caught like wildfire by 2012 as clients saw overwhelming value in having a sole source provider with full accountability. This value fueled rapid expansion of market share with existing clients and set Juniper up for an influx of new clients.

With that platform, Juniper added hundreds of clients over the next few years and balanced it’s construction & maintenance business substantially between residential, commercial & government work.

Under Dan’s leadership and in significant organic fashion, Juniper expanded into new geographic markets. Juniper’s footprint covers the entire southern half of Florida and services their clients from 9 branches and counting. Juniper is solicited to new markets for the largest and highest profile jobs in the state.

Dan built and manages a team of talented landscape architects and client managers that share the company’s vision and core values. Dan knows this is a people business and Juniper invests heavily in their people.

Chief Executive Officer

Brandon Duke is Juniper’s Chief Executive Officer and has been in the landscape industry for almost 15 years. He purchased the company from his father in 2016 after working with the family business since 2008. Under his leadership, Juniper has become the 17th largest landscaping company in the nation. 


Brandon has since worked tirelessly to make Juniper not only have an impressive reputation for quality of work, but also for a positive culture. He attributes an emphasis on collaboration and innovation combined with the utilization of data analytics to the rapid success of the company in recent years. Since Brandon became CEO, Juniper has grown from one location with 20 employees to 19 locations with nearly 2,000 employees, all of which he oversees. 


A Florida native, Brandon has lived here his entire life, with the only exception being when he attended Liberty University in Virginia to receive a degree in Business Management. There, he learned the importance of a united team as a starter on their football team for all four years. 


Brandon has been recognized as one of Lawn and Landscape’s Top 100 Landscapers consecutively for the past 7 years and is a Certified Irrigation Contractor. Most recently, he was named 2022 Entrepreneur of the Year by Business Observer after growing company revenue by an impressive 38.6% during the COVID-19 pandemic. 


Looking ahead, Brandon plans to achieve Juniper’s lofty goals with an unrelenting focus on company culture and by keeping technological advancements at the forefront of the company. He is confident that the only way he will continue to set landscaping industry standards is by surrounding himself with a team of passionate professionals.


Outside of work, Brandon most enjoys spending time with his wife of 14 years, Megan, and their three children (Kellen, Maddy, and Owen). As a family, they love to take advantage of Florida’s natural beauty, as Brandon is an avid pilot and boating enthusiast.
